OUR FEES

We are open and transparent about our hourly rates and fees.  Our smaller size and lower overhead allow us to keep our fees and rates reasonable and affordable, especially when compared to those of larger firms.  In addition to billing on an hourly basis, we may offer flat/project fee billing options, may invest in client equity offerings and, under appropriate circumstances, may defer partial payment pending a transaction close.

Use-Based Trademark Application

The use-based trademark application is utilized when you are seeking to register a trademark you are already using in commerce.

The above reflects the fees for legal services only, and does not include the filing fees assessed by the USPTO. In addition to our legal fees, you will be required to pay the actual filing fees that are required to be paid to the USPTO, which are generally $275 per class. All information on USPTO fees provided is subject to change and can be confirmed on USPTO.gov. The flat fee package rate is still due, even if a client ultimately elects not to file a prepared application. If your application receives an “office action” from the USPTO, we will bill you on an hourly basis to respond and such fees are excluded from the foregoing.

Intent-to-Use Trademark Application

The Intent-to-Use trademark application is utilized when you are seeking to register a trademark you are not yet using in commerce. If the USPTO signals that it will allow your trademark to register, this application route will always require the subsequent filing of a statement regarding use (a “SOU”) of the trademark in commerce, in order to continue the application. The SOU is due within 6 months of notice of allowance of the trademark to register, and that deadline may be extended up to five times.

If your application receives an “office action” from the USPTO, we will bill you on an hourly basis to respond and such fees are excluded from the foregoing.

Post-Registration Trademark Maintenance

Once a trademark is registered, the USPTO requires the submission of periodic confirmations of its use, coupled with report filing fees. The first such filing is due between the 5th and 6th year following registration. The second such filing is due between the 9th and 10th year following registration. Thereafter, a report (and fee) will be due every 10 years, to maintain the registration.

As stated above, these package fees exclude all filing fees. In order to file, you will be required to pay actual filing fees that are required to be paid to the USPTO. For these reports, the filing fee is generally $300 per class for the first maintenance filing, and $400 per class for ten year maintenance filings.
